Personal Data Protection and Cookies Charter

Welcome to the application My Fab House App’ hereinafter referred to as the “Application”). By downloading and using the Application, you agree that you have read, understood and accepted, without limitation or reservation, the present Personal data protection and cookies Charter (hereinafter the “Charter”) and our terms and conditions of use. Please note that other terms and conditions and Personal data and cookies charter apply to other Hutchinson Group applications, and we recommend that you read them carefully.

The Charter aims to inform you of the rights and freedoms that you can exercise in respect of our use of your personal data and describes the measures that we take to protect these data.

If you do not wish to allow Hutchinson to use your personal data through the Application, as indicated in this Charter, please do not install and use the Application.

Hutchinson, « Société Anonyme », registered capital of 52.947.648 euros, having its registered office in 2 rue Balzac 75008 Paris (France), registered in the Paris Trade and Company register under the number 542 051 826, is the “data controller” with responsibility for processing the personal data used to manage the Application. These processing operations are carried out in accordance with the applicable law.

1. Purpose of processing, legal basis, the period of storage and types of data collected

To use the Application and benefit from our services, you need to create an account and for this you need to provide us the following personal data: first name, surname and email address.

This Application presents the Company's Fab houses to you as well as its influence on social networks (links). The Company's Fab houses are places that allow our internal and external partners to present and discuss the Company's activities. The information provided in the Application is part of general information, without guarantee of suitability for a particular need of use. The Company can modify or update them at any time without notice.

Please note that depending on your profile (public, visitor or employee of the group) you will only be able to access certain features of our Application. Indeed, some are reserved for our partners and employees of the Hutchinson Group and TOTAL.

The processing of your personal data is based on your consent when you download and use the application through the creation of an account. This information is necessary to process your wish to use the Application and to benefit from the services offered by the Application, failing which it cannot be processed. You can withdraw your consent at any time without jeopardizing the treatment (s) carried out previously, by writing at the following address: data.protection@hutchinson.com.

In the account creation form, the mandatory fields are marked with an asterisk. If you do not provide answers to the mandatory questions, we will not be able to see if you participate in one of our events within one of our 3 Fab House and if yes create your account and you will not be able to benefit from the services provided by the Application.

Your personal data will not be processed subsequently in a way that is incompatible with the purposes described above. Your data are kept for the time necessary for the purpose of each processing as indicated below:

Processing operation 2: personalization of your profile (function, picture, web link LinkedIn) - until you delete them from your profile or,
- as long as you have not requested the deletion of this personal data the following address: data.protection@hutchinson.com, or
- in case of inactivity of your account for 3 years after receiving 2 emails (30 days and 4 days before the end of 3 years) to warn you of the closure of your account if no reconnection
Processing operation 3: private conversations (chat)
Nobody has access to your private conversations (encryption).
Each message will be automatically deleted 18 months + 1 day after sending
Processing operation 4: at each event in which you will participate your last name, first name and your position (if you have entered it in your profile) will appear in the list of participants in the tab past events, my event or others -3 years after the end of each event in which you participate -as long as you have not requested the deletion of this personal data the following address: data.protection@hutchinson.com, or
- in case of inactivity of your account for 3 years after receiving 2 emails (30 days and 4 days before the end of 3 years) to warn you of the closure of your account if no reconnection
Processing operation 5: you have the possibility to express your dietary restrictions through a fixed drop-down menu (ex: allergen-free, gluten-free, vegetarian menu etc ...) automatic deletion 24 hours after the end of each event in which you participate
Processing operation 6: you have the possibility of making a request for carpooling automatic deletion 24 hours after the end of each event in which you participate
Processing operation 7: to propose you to evaluate your Fab House experience through a satisfaction survey

12 months after sending your survey response.
Processing operation 8: you can publish one or more photos when you participate in an event organized within one of our Fab Houses - 6 months from the publication of the photo or,
- as long as you have not deleted it yourself when you are at the origin of the publication by going to the photo area of the event in which you are participating or
- as long as you have not exercised your right to delete a photo in which you appear by contacting the support service available in the Application.

In order to satisfy the purposes specified above, your personal data is transmitted to the subsidiaries of the HUTCHINSON Group as well as to the French company E-2LYS, developer of the Application, which subcontracts:

Any transfer of data to a country outside the European Economic Area shall be carried out in accordance with the applicable regulations and in such a way as to protect your data appropriately.

For the purposes of the services provided on the Application, your personal data may be transferred to the Hutchinson Group companies and to the Tunisian companies E-NANOTECH, ELYOS DIGITAL and ELYOS DIGITAL TUNISIE, which are the subcontractors of the French company E-2LYS for the creation and the development of the Application, located outside the European Union.

For this reason, the Hutchinson Group has adopted “Binding Corporate Rules” (BCR) governing intra-Group transfers of personal data originating in the European Economic Area.

For the purposes of the data processing operations carried out by Hutchinson SA, your data are transferred outside the European Union by the French company E-2LYS (our provider of the Application) to the following recipients:

4. Data security and confidentiality

The data controller takes appropriate steps to preserve the security and confidentiality of your personal data, including to prevent them from being distorted, damaged or disclosed to unauthorized third parties.

5. Cookie management

A cookie is a file that makes it possible to record information relating to your browsing on our Application and to facilitate it.

Cookies are text files that are placed on your mobile. They provide access to various information about you. Some of them belong to the publisher of the Application, others to third-party operators.

How to withdraw your consent?

When you log into the Application for the first time, you may or may not give your consent to the use of cookies and / or to make a setting. If you subsequently wish to change your choices, you can do so via the Application settings (Section: My profile).
To delete cookies already installed, please refer to the operating mode provided by your operating system (Windows, OS, etc.).

In accordance with current regulations, you have the right to access, rectify, delete and object to the use of your personal data. You can ask for your personal data to be sent to you and you have the right to give instructions for the use of your personal data after your death. You can also ask for restriction of the data processing or of data portability.

Finally, you can lodge a complaint with the authority responsible for compliance with personal data protection obligations (the CNIL for France or for other countries your local authority).

If our Application gives you access to websites, applications or social networks, they are not subject to this Charter. We advise you to consult the personal data protection charters / confidentiality declarations of these sites, applications or social networks to know their practices in terms of collection, use and disclosure of personal data.

8. Personal data of minors

Please note that browsing our Application is restricted to persons aged 18 and over and that we do not intend to collect or process personal data from minors under the age of 18. Therefore, if you are under the age of 18, please obtain the consent of your parents or guardian before creating an account on our Application. Without this prior consent, users under the age of 18 are not allowed to provide us with information and, if they did, we would stop processing their information as soon as we became aware of their age. We can not be held responsible if information belonging to minors was recorded at the time of connection in violation of these clauses.

This Charter was updated on March 30th, 2021. The latest version is available in the Personal Data section of our website. We reserve the right to revise and modify this Charter at any time, especially to ensure that we comply with regulatory and legal requirements.
